Print Agreement
These Landscape Management Services Terms and Conditions (“Terms”) are the only terms that govern the sale and provision of Services by New Beginning Landscape & Remodel LLC (“NBL&R”). The accompanying quote, proposal, order acknowledgement or invoice (“Order”) and these Terms (together, the “Agreement”) comprise the entire agreement between NBL&R and the customer (“Customer”), and supersede all prior or contemporaneous communications, understandings or agreements (whether verbal or written). NBL&R and Customer are sometimes referred to in this Agreement individually as a “Party” and collectively as the “Parties.”
These Terms prevail over, and NBL&R expressly rejects, any of Customer’s general terms or conditions of purchase. Neither the failure of NBL&R to object upon receipt of Customer’s terms nor the fulfillment of Customer’s order shall constitute acceptance of Customer’s terms. If there is any conflict between these Terms and those in the Order, the specific modifications in the Order shall govern.
THESE TERMS ARE SUBJECT TO CHANGE by NBL&R at any time, without prior notice. Updates will be effective as of the "Last Updated Date" on the NBL&R website: www.newbeginninglandscape.com. Continued use of services after this date constitutes Customer’s acceptance.
1. Services
NBL&R shall perform the landscape management services described in the Order, which may include mowing, trimming, fertilization, cleanup, plant bed maintenance, shrub trimming, and more (collectively, “Services”) at the specified Service Location(s). Watering and trash removal are not included unless stated in the Order. Changes must be agreed upon in writing. NBL&R provides all necessary personnel, materials, and equipment. NBL&R decides when Services are necessary and may delay service due to extreme weather to ensure employee safety.
2. Fees and Payment
Customer shall pay all invoiced fees ("Fees") as specified in the Order. NBL&R may charge a $250 admin fee for service change requests. All taxes are the Customer's responsibility unless a tax exemption certificate is on file. Fees may increase up to 5% annually.
(a) Invoices and Payment.
Invoices may be issued daily, weekly, bi-weekly, or monthly. A 15% fee applies for other billing arrangements. Payment is due within 30 days. A 1.5% monthly (18% annually) late fee applies to unpaid balances. Collection and legal fees are Customer's responsibility.
(b) Record Requests.
Customer may request service records within 30 days of the invoice date. A reasonable admin fee will apply.
3. Term and Termination
(a) Term. The Initial Term is one year, renewing annually unless Customer cancels in writing at least 60 days before renewal. Renewal is subject to revised Terms.
(b) Service Period. Services are provided April 1st to November 30th each year.
(c) Termination. NBL&R may cancel service for non-payment, breach, or insolvency. All completed services must be paid in full upon termination.
(d) No Early Termination. Early cancellations are subject to a termination fee of $500 or 10% of the remaining contract value. NBL&R may suspend services for non-payment and terminate the agreement after 30 days of delinquency.
4. Site Conditions
(a) Customer Responsibilities. Customer must clearly mark boundaries and provide access, disclose any concealed conditions, and share any site studies. Utility notification costs are Customer's responsibility.
(b) Safe Work Environment. The site must be safe and accessible. NBL&R may refuse service if the location is deemed unsafe.
(c) Property Conditions. If a site is not up to standard, NBL&R may re-quote the Services or refuse to perform.
5. Warranties
NBL&R warrants that it will perform services professionally and in compliance with applicable standards. All other warranties are disclaimed. Customer’s sole remedy is re-performance of services.
6. Limitation of Liability
NBL&R is not liable for damages caused by:
- Natural events or force majeure
- Concealed site conditions
- Customer's failure to fulfill obligations
- Work performed beyond unmarked boundaries
- Services done in compliance with standards or manufacturer guidelines
NBL&R's total liability shall not exceed the fees paid for services rendered. NBL&R is not liable for indirect or consequential damages.
7. Confidential Information
Customer agrees not to disclose any confidential information shared by NBL&R without written consent. All confidential materials must be returned upon request. Breach may result in injunctive relief.
8. Insurance
NBL&R shall maintain commercial general liability, umbrella, and workers' compensation insurance. Certificates of insurance are available upon request.
9. Subcontractors
NBL&R may hire subcontractors to perform services but remains responsible for their performance and compliance.
10. Relationship of Parties
NBL&R is an independent contractor. Neither Party has authority to bind or represent the other.
11. Force Majeure
Neither Party is liable for delays due to force majeure events. Parties must notify each other of delays and make efforts to resume service. Either may terminate after 60 days of continuous delay.
12. Assignment
Customer may not assign this Agreement without NBL&R’s written consent.
13. Survival
Provisions intended to survive termination will remain in effect.
14. Governing Law; Venue; Jurisdiction
This Agreement is governed by the laws of the State of Georgia. Venue shall lie in the courts of Fulton County, Georgia. NBL&R is entitled to recover all costs, including attorney’s fees, in any dispute.
15. Entire Agreement
This Agreement, including the Order, represents the full agreement between the Parties. No oral waivers are valid unless written and signed. Invalid provisions do not affect enforceability of the rest of the Agreement.
16. Execution
This Agreement may be signed electronically and in counterparts, each of which is valid. Electronic signatures have the same effect as original signatures.

By hiring New Beginning Landscape & Remodel LLC, you agree that we may take before-and-after photos of your property for documentation, portfolio, and marketing purposes (including but not limited to our website, social media, and printed materials).
No identifying personal information or addresses will be shared without consent.
If you prefer that we do not use photos of your project, you must notify us in writing before work begins.
4. SMS/Text Message Communication
By providing your phone number, you consent to receive SMS/text messages from New Beginning Landscape & Remodel LLC related to appointments, estimates, job updates, promotions, or customer service.
Message and data rates may apply.
You can opt out at any time by replying STOP to any text message.

5. Payments & Deposits
All estimates are provided in writing. Some services may require a deposit before scheduling. Final payment is due upon project completion unless otherwise agreed in writing.
6. Cancellations & Rescheduling
Please provide at least 24 hours’ notice for cancellations or rescheduling. New Beginning Landscape & Remodel LLC reserves the right to cancel or reschedule due to weather conditions or unforeseen circumstances.
7. Warranties & Liability
We strive to deliver quality workmanship. However, we are not responsible for damage due to pre-existing issues, acts of nature, or misuse. Warranty on labor or materials (if applicable) will be provided in writing per job.
8. Intellectual Property
All content on this website, including text, graphics, logos, and images, is the property of New Beginning Landscape & Remodel LLC and may not be used without permission.
9. Privacy Policy
We respect your privacy. Personal information collected through our website or via SMS is used solely for communication and service-related purposes and is never sold or shared with third parties.
10. Changes to Terms
We reserve the right to modify these terms at any time. Changes will be posted on this page and are effective immediately upon posting.
